1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern all services and digital materials provided by Metabolix LLC(“Metabolix,” “we,” “us,” “our”). By visiting our website, booking a service, or using any Metabolix materials, you agree to be bound by these Terms and all applicable U.S. and California laws. If you do not agree, do not use our services.

2. Services

Metabolix provides performance and metabolic testing, data-driven training analysis, educational content, and related wellness services (“Services”). All Services are for informational and educational purposes only and do not constitute medical advice, diagnosis, or treatment. Consult a licensed healthcare professional before making any health or lifestyle changes.

3. Booking, Cancellations, and Rescheduling

Appointments may be scheduled online or by phone. To ensure fairness and operational efficiency, all clients are expected to adhere to the following policy:

​

• Cancellations made at least 48 hours before your appointment are eligible for a full refund.

​

• Reschedules made at least 48 hours before your appointment are subject to no additional charge.

​

• Cancellations and reschedules made within 48 hours of the scheduled appointment will incur a $50 administration fee.

​

• Same-day cancellations, or failure to attend (no-shows) will result in a 50% service fee.

​

4. Payments

All prices are in U.S. Dollars (USD). Payments are processed securely through authorized processors (e.g., Wix Payments U.S.). Metabolix does not store card details or financial data.

5. Health and Liability Disclaimer

​

Participation in metabolic or performance testing involves physical exertion and inherent risks, including but not limited to injury, illness, or death. By booking a test, you confirm that you are in appropriate physical condition to participate and that you have disclosed any relevant medical conditions to our staff.

To the fullest extent permitted by law, you voluntarily assume all risks associated with participation and release Metabolix LLC, its owners, staff, and affiliates from any and all liability for injury, illness, death, loss, or damages arising from participation in testing, interpretation of results, or any subsequent training, nutrition, or lifestyle decisions made based on our services.

This waiver does not apply to liability resulting from gross negligence or intentional misconduct by Metabolix LLC or its representatives.

6. Intellectual Property and Proprietary Rights

All content, methodologies, data systems, test protocols, scoring scales, analytics frameworks, reports, logos, trademarks, graphics, video, text, and other materials (collectively “Materials”) are the exclusive intellectual property of Metabolix LLC and are protected by U.S. copyright, trademark, and trade-secret laws.

You may not copy, reproduce, publish, modify, distribute, sell, display, perform, reverse-engineer, or otherwise use any part of the Materials for commercial, educational, or derivative purposes without prior written permission from Metabolix LLC.

Unauthorized use constitutes infringement and may result in civil or criminal penalties. Metabolix actively enforces its rights under U.S. Copyright Law (17 U.S.C. § 501 et seq.) and federal Trademark Law (15 U.S.C. § 1114 et seq.).

All testing reports, data interpretations, and analytical outputs remain the property of Metabolix LLC and are licensed to clients solely for personal, non-commercial use.

7. Confidential and Proprietary Information

Clients and partners agree that all protocols, data analysis methods, and training frameworks disclosed by Metabolix are confidential trade secrets. You shall not reproduce, share, teach, or otherwise disclose such information without written consent. Any misuse will be pursued under state and federal intellectual-property law.

8. Third-Party Tools and Links

Our website may include integrations or links to third-party services. These are provided “as is” without warranty. Metabolix is not responsible for the availability, accuracy, or security of third-party content or tools. Use them at your own risk and review their terms separately.

9. Privacy and Data Protection

Metabolix complies with the California Consumer Privacy Act (CCPA) and all other applicable privacy regulations. Personal data collected through testing, bookings, or online activity is used solely for legitimate business purposes and never sold to third parties. 10. Changes to Services or Terms

We may modify, suspend, or discontinue any Service or revise these Terms at any time. Significant changes will be posted with 30 days’ notice. Continued use after updates constitutes acceptance of the revised Terms.

11. Dispute Resolution and Governing Law

These Terms and any dispute arising from them are governed by the laws of the State of California, without regard to conflict-of-law principles. All disputes shall be resolved by binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association. You waive the right to participate in a class action.
